These fragments were used as a pastedown (fol. 1) and flyleaf (fol. 2) in the binding of
Lambach, Stiftsbibliothek, Ccl 337. The shelf number "337" is marked on fol. 2r; both leaves
have the pencil notations "337P", probably made when the leaves were removed from the
binding. The inscription "Sermones ..." is written on fol. 1r. In the margin of fol. 2 v, a
thirteenth- or fourteenth century hand has written "[Hunc] librum comparauit [ ... ]us de Monte
[Orate] pro eo."
The number "108" is written in pencil in a modern hand in the lower right corner of fol.
2r and the number "109" is in the lower right corner of fol. 1v.
Fol. 1 was formerly Zinniker 227; fol. 2 was Beinecke MS 482.93, Zinniker 46.

Papal mandatum (litterae cum filo canapis) to archbishops, bishops, etc.,
commanding that Franciscan friars be received charitably. The docket on the
verso reads "Gregorius 9 fratres undique benigne recipiant." We have not found
the text in A. Potthast, Regesta pontificum (Berlin, 1874-5) nor in L. Auvray, Les
Regestes de Gregoire IX (Paris, 1896-1955).
Parchment. 1 folio. 250 x 215 mm (written space 169 x 232 mm). 1 column. 13 lines. Ruled
in dry-point on the flesh side.
Written in chancery script. Large initial "G" and 1-line capitals are in brown.
Punctuation consists of the punctus. Hyphenation is in the same ink as the text. The rope for the
seal is at the bottom of the document. There are no chancery marks or signatures under the fold.
A modern hand has written "Gregor IX 492981" on the verso in pencil.

Based on rubrics and content, the text seems to be a commentary on chapters of either Innocent
IV's third collection of Decretals from the first Council of Lyon in 1245 (cf. J.D. Mansi,
Sacrorum Conciliorum Nova, et Amplissima Collectio, vol. 23 [Venice, 1779], coll. 651-74); or
the Sixth Book of Decretals of Pope Boniface VIII. (cf. E. Friedberg, Corpus Iuris Canonici, vol.
2, Collectione decretalium [Leipzig, 1922], coll. 933-1124. Rubrics of various medieval
collections of canon law can be found in S. Kuttner, Index Titulorum Decretalium ex
Collectionibus tam Privatis quam Publicis Conscriptus, Ius Romanum Medii Aevi, Subsidia II,
(Milan, 1977).

elevatus. The text is written in the center of the page and is surrounded by two columns of

upper right corner of the verso and "M106" in the lower left corner of the verso. The last
inscription is by the same hand that wrote "M103" on Beinecke MS 481.68 and "M105" on
Beinecke 481.70.

This text is not found in P. Glorieux, La Litterature Quodlibetique de 1260 a 1320 (Kain, 1925,
1935). Professor Timothy Noone of Catholic University, Washington, D.C. (letter in correspondence file)
has suggested that the text seems heavily influenced by the metaphysical views of Henry of
Ghent (fl. 1276-92), and may have been written by one of his students. It is not among the
known works of Richard of Conington, who was "a great defender of Henry of Ghent in the late
thirteenth century."

title refers to the Compendio d'errori by Ambrosius Catharinus Politus. An edition of this work
was published in 1544 in Rome (In Roma ne la Contrada del Pellegrinus per M. Girolama de
Cartolari, a instantia di M. Michele Tramezino. MDXLIIII), with two other tracts by the same
author, the Resolutione sommaria contra le conclusioni luterane and the Reprobatione de la
dottrina di frate Bernardino Ochino. Because the measurements of the edition of these three
works correspond closely to those of the volume bound by the Beinecke fragment, it is likely
that the Beinecke fragment was used as a binding for a copy of this edition.

The text contains the last sections of the Mishnah and Talmud of Chapter I, including
interpolations of the running commentary of Rashi (Rabbi Solomon Yitzhaqi of Troyes, ca.
1040-1105). It contains a discussion of various cases that illustrate a common principle of
mutual exclusion, whereby when one of two conditions is required, the other is excluded. The
cases involve a father's responsibility for his minor daughter; levirate marriage obligations; when
the ram's horn (shofar) is blown; and when the separation (havdalah) prayer is said at the end of
a festival. The verso concludes with the beginning of Chapter II which resumes the main
subject, the laws and principles of the ritual killing of animals for food.
